Terms & Conditions

For the purpose of these Terms:

• “User” includes any individual or entity (buyer, seller, tenant, agent, builder, or visitor) accessing the Platform.
• “Listing” means any property-related content published on the Platform.
• “Services” include listing, discovery, advertising, lead generation, and value-added offerings.
• “User Data” refers to all information submitted by Users, including personal and property details.

Search Abode operates as a technology-enabled real estate marketplace, offering:

• Property listings (sale, commercial)
• Property discovery and search tools
• Lead generation and marketing services
• Featured and premium listing solutions
• Ancillary services (home loans, interiors, legal assistance, etc.)

Clarification: Search Abode is not a broker, owner, or transaction party. We act solely as an intermediary platform facilitating connections.

• Users must be 18 years or older
• Must be legally competent to contract
• Must provide true, accurate, and complete information

• Certain Services are paid and subscription-based
• Fees are displayed on the Platform or agreed separately
• Services are activated upon successful payment

• All payments are advance and non-transferable
• A portion of the fee is treated as activation/administrative charges (non-refundable)
• Remaining amount may be refunded on a pro-rata basis, subject to usage

Key Conditions:

• Refunds are processed within 4-6 weeks
• Refund approval is at the sole discretion of Search Abode
• No interest shall be payable on refunds

• Users agree not to initiate unjustified chargebacks
• Any payment dispute must be raised directly with Search Abode
• Unauthorized chargebacks may result in:
  • Immediate account suspension
  • Recovery proceedings

• Services, once activated, are generally non-cancellable
• Premium or featured listings are strictly non-refundable
• Exceptions, if any, are granted solely at our discretion

• Payments are processed via secure, compliant payment gateways
• Search Abode does not store sensitive financial data
• Users are responsible for safeguarding login credentials

Users agree to:

• Provide accurate and lawful information
• Ensure legal rights to list properties
• Comply with applicable laws (including RERA, where applicable)
• Maintain confidentiality of account credentials
• Bear applicable taxes and charges

Users shall not:

• Post false, misleading, or illegal listings
• Upload offensive, harmful, or restricted content
• Use bots, scraping tools, or automated extraction
• Impersonate any individual/entity
• Engage in spam or unauthorized promotions

Consequences: Violation may lead to account suspension, forfeiture of fees, and legal action.

All content available on the Platform, including but not limited to text, images, graphics, logos, design elements, software, databases, and proprietary features, is the exclusive property of Search Abode or its licensors and is protected under applicable intellectual property laws.

By submitting any content (including listings, images, descriptions, reviews, or other materials), the User:

• Grants Search Abode a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, and sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute such content across any media or platform.
• Confirms that they have the legal right and authority to upload and share such content.

Users shall not:

• Copy, reproduce, distribute, or exploit any Platform content without prior written consent
• Use Platform data for commercial purposes, scraping, or unauthorized extraction

Any violation may result in legal action and claims for damages.

Users acknowledge that they may have access to confidential, proprietary, or sensitive information relating to Search Abode, its partners, or other Users.

Accordingly, Users agree to:

• Maintain strict confidentiality of such information
• Not disclose, share, or misuse such data for personal or third-party benefit
• Use such information solely for legitimate purposes related to the Platform

This obligation shall:

• Continue during and after termination of account or Services
• Apply regardless of whether such information is explicitly marked confidential

Search Abode reserves the absolute right to modify, update, or revise these Terms at any time without prior notice.

• Updated Terms will be published on the Platform
• Users are responsible for periodically reviewing the Terms

Continued use of the Platform after such updates constitutes full acceptance of the revised Terms.

Search Abode may, at its sole discretion:

• Modify, enhance, restrict, suspend, or discontinue any part of the Services
• Introduce new features or remove existing functionalities

Additionally:

• Temporary interruptions may occur due to maintenance, upgrades, or technical issues
• Search Abode shall not be liable for:
  • Service downtime
  • Data loss
  • Inconvenience caused due to interruptions

The Platform may contain links to third-party websites, services, or resources.

• Such links are provided for convenience only
• Search Abode does not:
  • Control
  • Endorse
  • Guarantee

the accuracy, reliability, or quality of third-party services.

Users acknowledge that:

• Accessing third-party services is entirely at their own risk
• Any transactions or interactions with third parties are independent of Search Abode

Search Abode reserves the right to, at its sole discretion and without prior notice:

• Suspend or permanently terminate User accounts
• Remove or restrict access to listings or content
• Block access to the Platform

Grounds may include:

• Violation of Terms
• Suspicious or fraudulent activity
• Legal or regulatory requirements

Search Abode may temporarily suspend Services due to:

• Technical maintenance or system upgrades
• Security concerns or breaches
• Violation of platform policies

During such suspension:

• Access to the Platform or specific features may be restricted
• No compensation, refund, or damages shall be payable

Refunds, if applicable:

• Are limited, conditional, and discretionary
• Depend on:
  • Service usage
  • Nature of subscription
  • Compliance with refund criteria
• Key points:
  • Certain services are strictly non-refundable
  • Refund processing timelines may vary
  • No guarantee of refund approval

Any breach of these Terms may result in:

• Forfeiture of subscription fees
• Legal action, including claims for damages

Search Abode reserves the right to take appropriate action without prior notice.

The Platform may contain:

• Inaccurate pricing or property details
• Outdated or incomplete information

Search Abode:

• Does not warrant the accuracy or completeness of such content
• Reserves the right to correct errors at any time without notice

Users are advised to independently verify all information.

Search Abode operates as an intermediary platform and:

• Does not verify all property listings
• Does not guarantee:
  • Property authenticity
  • Transaction completion
  • Pricing accuracy

We are not responsible for:

• Misrepresentation by Users
• Disputes between parties
• Outcomes of transactions

Use of the Platform is strictly at your own risk.

To the maximum extent permitted by law, Search Abode shall not be liable for:

• Any direct, indirect, incidental, or consequential damages
• Property-related disputes
• Financial losses arising from transactions
• Unauthorized account usage
• Failures or actions of third-party service providers

Users agree to indemnify, defend, and hold harmless Search Abode, its directors, employees, and affiliates from:

• Claims arising from User Listings or content
• Breach of these Terms
• Violation of laws or third-party rights

This includes:

• Legal costs
• Damages
• Liabilities

Notices

• All communications via email, SMS, or platform notifications shall be considered valid legal notice

Waiver

• Failure to enforce any provision shall not constitute a waiver of rights

Severability

• If any provision is held invalid, remaining provisions shall continue to be enforceable

Entire Agreement

• These Terms constitute the complete agreement between the User and Search Abode

• These Terms shall be governed by the laws of India
• Any disputes shall be subject to the exclusive jurisdiction of courts in Jaipur

By accessing or using the Platform, the User:

• Confirms that they have read and understood these Terms
• Agrees to be legally bound by them
• Accepts all rights, obligations, and conditions stated herein

Search Abode may provide estimated property values through automated tools, data analytics, or market-based algorithms (“Property Valuation Services”). These valuations are derived from various data points, including historical transactions, location trends, and market conditions.

However:

• Such estimates are indicative in nature and intended solely for informational purposes.
• They do not constitute professional valuation advice, financial guidance, or a formal appraisal.
• Search Abode does not guarantee accuracy, completeness, or reliability of such estimates.
• Users are strongly advised to seek independent professional valuation before making any financial or transactional decisions.

Under no circumstances shall these estimates be considered legally binding or enforceable

Search Abode may facilitate access to home loan products through partnerships with banks, NBFCs, or financial institutions.

Key clarifications:

• Search Abode acts strictly as a referral or facilitation platform and not as a lender, broker, or financial advisor.
• Loan approval, eligibility, interest rates, and disbursal are solely determined by the respective financial institution.
• Search Abode does not guarantee loan approval or specific terms.
• Any disputes, delays, or issues arising from loan processing must be addressed directly with the lender.

Users are encouraged to review all loan documents and terms independently before proceeding.

Search Abode may offer interior design or home improvement services through third-party vendors or partner agencies.

• These services are executed entirely by independent service providers.
• Search Abode’s role is limited to facilitating connections between Users and vendors.
• We do not guarantee:
  • Quality of work
  • Timely completion
  • Design outcomes or materials used

  Any agreement for such services is strictly between the User and the vendor. Search Abode shall not be liable for any deficiency, delay, or dispute arising from such services.

• Search Abode may assist in scheduling or coordinating property site visits for Users.
• Search Abode does not own, control, or manage the properties being visited.
• Users acknowledge that:
  • They visit properties at their own risk
  • They are responsible for verifying property details, ownership, and condition

Search Abode shall not be liable for:

• Any injury, loss, or damage during site visits
• Misrepresentation by property owners, agents, or third parties

Search Abode may provide tenant verification services using third-party databases or background verification partners.

• Verification reports are based on available external data sources
• Search Abode does not independently verify or authenticate such data
• The results are indicative only and not guaranteed to be accurate or complete

Users should treat verification reports as supporting information only and must conduct additional checks if required.

Search Abode may facilitate property inspection services through third-party professionals.

• Inspection reports are limited to observable conditions at the time of inspection
• They do not constitute:
  • Structural guarantees
  • Legal certifications
  • Future condition assurances

Search Abode does not guarantee the accuracy or completeness of such reports. Users are advised to conduct independent due diligence before making decisions.

Search Abode may provide access to Vastu consultation services via experts or consultants.

• Vastu advice is subjective and belief-based
• It is provided purely for informational or cultural purposes
• Search Abode does not guarantee:
  • Accuracy of advice
  • Positive outcomes or results

Users rely on such services at their own discretion and belief.

Search Abode acts as a platform for publishing property listings submitted by Users.

• Property owners, agents, or advertisers are solely responsible for:
  • Accuracy of listings
  • Ownership claims
  • Pricing and property details

Search Abode:

• Does not verify all listings
• Does not guarantee authenticity, legality, or availability

We act strictly as an intermediary platform and are not a party to any transaction between Users.

Search Abode may offer premium subscription plans (e.g., “Search Abode Prime”) that provide enhanced visibility and additional features.

• Benefits may include:
  • Featured listings
  • Higher ranking in search results
  • Priority lead generation

Important terms:

• This is a visibility enhancement service only, not a guarantee of sale, rent, or leads
• Fees are non-refundable once the service is activated
• Performance may vary based on market conditions and user demand

Search Abode may connect Users with legal professionals for services such as documentation, agreements, or property-related advice.

• These services are provided by independent third-party lawyers or firms
• Search Abode is not a law firm and does not provide legal advice
• We do not guarantee:
  • Legal outcomes
  • Accuracy of advice
  • Timely resolution

Any engagement is strictly between the User and the legal professional. Search Abode shall not be liable for any disputes, losses, or claims arising from such services.
